The Higher Qualification and Disciplinary Bar Commission have published already information regarding several court verdicts imposing administrative fine to officials who didn’t respond on attorney’s requests.

On October 31, 2013 Vasylkivskyi Municipal District Court of Kyiv Region returned another verdict, based on the consideration of the administrative case on holding the Head of the rural council liable, provided by the Bar Council of Kyiv Region, which found the official guilty of committing the offence envisaged by the Article 212-3 of the Code of Ukraine on Administrative Offences and imposed an administrative fine.

Mentioned court verdict is based on the fact that the Head of the rural council has twice failed to respond to the attorney’s request on providing data on the functioning of the public catering located within the territory of the rural community thereby violating prescriptions of the Law of Ukraine “On the Bar and Advocacy”.

Meanwhile, the Head’s arguments on not responding on attorney’s request due to lack of time and a vacation of the rural Council Secretary have not been taken into account by the Court.
