The Higher Qualification and Disciplinary Bar Commission of Ukraine announces that on 4 March 2013 the District Administrative Court of Kyiv rejected an administrative claim brought by Mr. Vladimir Vysotsky to recognize illegal the state registration of the Commission.

Earlier on 19 November 2012 the state registrar of Pechersk District State Administration in Kiev O. Savenkova conducted state registration of changes in information about the Higher Qualification and Disciplinary Bar Commission of Ukraine at the Cabinet of Ministers of Ukraine, contained in the Unified State Register due to the changes in the name, location and management of the said entity (new name – “Higher Qualification and Disciplinary Bar Commission of Ukraine”, location: 7 Klovsky Descent, Letter A, Suite 6, Kyiv 01021,  and the new Chair – Valentyn M. Zagariya).

The Court found that the plaintiff’s arguments that the former Higher Qualification Bar Commission at the Cabinet of Ministers of Ukraine should have been reorganized to the Higher Qualification and Disciplinary Bar Commission of Ukraine on the basis of paragraph III, article 7 of Chapter X “Transitional Provisions” of the Law of Ukraine “On the Bar and Advocacy” were unfounded and baseless.

In addition, the Court found that all necessary documents required by law were duly submitted for the state registration, and the state registrar had no reason for leaving them without consideration or deny in state registration.
