The Higher Qualification and Disciplinary Bar Commission inform that on March 23, 2014 at 17.00 has expired the period of custody as of moment of detention advocate Denys Bugay. It should be reminded that no later than 60 hours from the moment of custody the person has to be either released or brought to the court for selecting a restrictive measure.

Current location of advocate Denys Bugay is unknown, lawyers has no access to him. This fact breaks the right to defense. Executive Chairman of the Commission Oleg Beliaev, Head of the Bar Council Inna Rafalska, Vise-president of the Ukrainian Bar Association Oleksiy Reznikov as well as more than 50 attorneys arrived to detention facility of the Security Service of Ukraine in Kyiv for preventing illegal actions regarding the advocate.

The Ukrainian Parliament Commissioner for Human Rights Valeriya Lutkovska has joined the attorneys’ community and published on her official web site open address to the acting General Prosecutor Oleg Mahnitskyi regarding timeline of violations of the criminal procedural law during Mr. Bugay’s detention.

“By the way, we fight against such human rights violations by law enforcement officials during the arrest of activists in the Independence Square. Unfortunately, systematic violations persist. What impresses most of all is that that such violations are committed by employees of the General Prosecutor’s Office, who have to serve as an example of the application of criminal procedural law”, – noted Valeriya Lutkovska in her address.

At 20.00 Executive Chairmen of the Commission Oleg Beliaev, Deputy Chairmen of the Commission Oleg Makarov and Ombudsman Valeriya Lutkovska arrived to the Prosecutor General’s Office of Ukraine to present official address concerning violation of the right to defense during investigation regarding Denys Bugay without his attorney’s presence.

The Commission hopes for intervention of the Prosecutor General’s Office of Ukraine and restoration of human rights of advocate Mr. Denys Bugay.
