On November 27, 2013 having examined appeal from the representative of the Bar Council of the Kyiv region, deputy of the Head of the Committee for the  defense of attorneys’ rights Andriy Grubskyi on inaction of the prosecutor of Shevchenkivskyi district of the city of Kyiv that did not enter data on criminal offence in the Unified register of prejudicial inquiry, investigation judge of the Shevchenkivskyi district court of the city of Kyiv rendered court order on compelling prosecutor of the Shevchenkivskyi district of the city of Kyiv to indicate adequate data to the Unified register of prejudicial inquiry.

According to the mentioned order of the investigation judge of the Shevchenkivskyi district court of the city of Kyiv, on November 13, 2013 Andriy Grubskyi has filed a report regarding criminal offence to Shevchenkivskyi District Department of General Direction of Ministry of Internal Affairs of Ukraine in the city of Kyiv, due to the fact of the search of the workplace of advocate Hanna Kolesnyk. However, officials of Shevchenkivskyi District Department of General Direction of Ministry of Internal Affairs of Ukraine in the city of Kyiv did not include data regarding criminal offence to the Unified register of prejudicial inquiry and turned over mentioned report of Andriy Grubskyi to prosecution of Shevchenkivskyi district of the city of Kyiv.

Moreover, there relevant data still have not been entered in the Unified register of prejudicial inquiry.

Valentyn Zagariya noted, “The conclusion of the investigation judge confirms first changes in the protection of guarantees of advocates’ activity that are achieved by advocate’s self-governance bodies due to the recent searches of advocate’s workplaces”.

On November 13, 2013 representatives of the Security Service of Ukraine violated the guarantees of attorney’s professional rights during the investigation in the premises rented by attorney Hanna Kolesnyk.
