On 7 June 2013, mass media disseminated information that Kyiv Administrative Court of Appeal divested Head of Brovarskyi local branch of the UDAR political party Roman Simutin the right to conduct attorney’s practice and excluded him from the Unified register of advocates of Ukraine. Member of Parliament (“UDAR” faction) Pavlo Ryzanenko considers this to be triggered by Roman Simutin’s participation in the case of activists who were detained by police in Brovarskyi park “Peremoga” on 25-th of May, 2013.

Valentyn Zagariya, the Head of the Higher Qualification and Disciplinary Bar Commission of Ukraine, commented on this situation: “The information disseminated by UDAR’s press office is not correct, since according to the Article 33 of the Law of Ukraine “On the Bar and the Legal Profession” the court has no right to carry such ruling because disciplinary procedure related to an advocate is conducted by the Qualification and Disciplinary Bar Commission at the location of the working place of advocate recorded in the Unified register of advocates of Ukraine”.

On August 30, 2012 Qualification and Disciplinary Bar Commission of Kyiv region decided to stop R. Simutin’s right to conduct attorney’s practice by canceling relevant certificate for conducting attorney’s activity.

Roman Simutin submitted an appeal to the Kyiv County Administrative Court, which on November 14, 2012 satisfied it and canceled decision of Qualification and Disciplinary Bar Commission of the Kyiv region.

In turn, Qualification and Disciplinary Bar Commission of the Kyiv region submitted an appeal. Consequently, the Kyiv Administrative Court of Appeal canceled decision of the first instance and upheld decision of the Qualification and Disciplinary Bar Commission.

Qualification and Disciplinary Bar Commission of the Kyiv region during the decision making process made legal expertise on the advocate’s actions that were not connected to his political activities in any way. More specifically, advocate Roman Simutin beard disciplinary responsibility due to violating rules of advocate’s ethics.

Thus Roman Simutin was deprived of the right to conduct attorney’s practice in August of the previous year that is why this cannot be connected to the current political events Pavlo Ryzanenko refers to.
