The information regarding court verdicts on administrative fine imposition regarding officials who gave no response on attorney’s requests has already been mentioned in the news feed of the Higher Qualification and Disciplinary Bar Commission.

On January 13, 2014 Zaliznychnyi District Court of Kyiv returned a verdict, based on the consideration of the administrative case regarding the Head of the garage co-operative “Avtolubitel – 1”, according to which the latter was found guilty of committing the offence envisaged by the Article 212-3 of the Code of Ukraine on Administrative Offences, and imposed an administrative fine.

Mentioned court verdict is based on the fact that the Head of the garage co-operative “Avtolubitel – 1” provided the attorney with the incomplete response in terms of lack of the documents requested by attorney in violation of the second part of the Article 24 of the Law of Ukraine “On the Bar and Advocacy”.

The Head of the Commission Valentyn Zagariya commented mentioned court verdict: “Attorney’s self-governance bodies are still consistent with realization of their obligations regarding attorneys. There has been an increase in quantity of the court verdicts which found the officials guilty and brought them to administrative responsibility. This indicates that the mechanism of realization of attorney’s right to information effectively applies in practice”.
